1. Agreement to Terms

By accessing or using Surf Report (the "Service"), operated by Staticscale LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms apply to all visitors, users, and others who access or use the Service, including our website at surf-status.com and our email notification services.

2. Description of Service

Surf Report provides:

• Real-time ocean conditions including tide levels, swell data, water temperature, and weather information
• Aggregated ocean condition ratings and scores
• Interactive maps and charts displaying marine data
• Email notification services including daily condition reports and surf alerts

Our data is sourced from government agencies including NOAA, the National Weather Service, and the National Data Buoy Center, as well as other third-party providers.

3. Eligibility

You must be at least 13 years of age to use this Service. By using the Service, you represent and warrant that you are at least 13 years old. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

4. Email Subscriptions

Our Service offers email notifications including:

• Daily Digest: A daily email with ocean conditions for your selected location, sent at your preferred time
• Surf Alerts: Notifications when ocean conditions at your selected location meet your specified threshold

By subscribing, you agree to receive these communications. You may unsubscribe at any time using the unsubscribe link in any email or by updating your preferences.

To protect against automated abuse, our subscription form uses Cloudflare Turnstile for bot detection. By subscribing, you acknowledge that your interaction with this verification service is subject to Cloudflare's Privacy Policy.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or servers
• Use automated systems (bots, scrapers) to access the Service without permission
• Redistribute, resell, or commercially exploit Service data without authorization
• Attempt to reverse engineer any part of the Service

6. Data Disclaimer and Limitation of Liability

NO WARRANTY: The Service and all data, content, and information provided through it are provided "AS IS" and "AS AVAILABLE" without any warranties of any kind, either express or implied, including but not limited to:

• Warranties of accuracy, completeness, or reliability of data
• Warranties of timeliness or currency of information
• Warranties of fitness for a particular purpose
• Warranties of non-infringement

ASSUMPTION OF RISK: You expressly understand and agree that:

• Ocean and weather conditions can change rapidly and unpredictably
• Data may be delayed, incomplete, or inaccurate due to sensor malfunctions, transmission errors, or other technical issues
• Our condition ratings and scores are algorithmic calculations that may not reflect actual conditions
• Our ratings do not account for time of day, lighting conditions, visibility, crowds, or other environmental factors beyond ocean conditions
• You use any information from this Service entirely at your own risk
• You are solely responsible for your own safety and the safety of others when engaging in ocean activities

LIMITATION OF LIABILITY: To the maximum extent permitted by applicable law, Staticscale LLC and its officers, directors, employees, agents, and affiliates shall not be liable for any:

• Personal injury, death, or physical harm
• Property damage or loss
• Direct, indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or other intangible losses

arising out of or related to your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

INDEMNIFICATION: You agree to indemnify and hold harmless Staticscale LLC from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

7. Intellectual Property

The Service and its original content (excluding user-provided data and third-party data sources), features, and functionality are owned by Staticscale LLC and are protected by copyright, trademark, and other intellectual property laws.

Our aggregation, presentation, and rating methodology constitute our proprietary work product.

8. Third-Party Data and Links

Our Service incorporates data from third-party sources including government agencies (NOAA, NWS, NDBC) and other providers. We do not control and are not responsible for the accuracy or availability of third-party data.

Any links to third-party websites are provided for convenience only and do not imply endorsement.

9. Termination

We reserve the right to terminate or suspend your access to the Service immediately, without prior notice, for any reason, including breach of these Terms.

You may stop using the Service at any time. To unsubscribe from email notifications, use the unsubscribe link in any email.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of Delaware.

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last updated" date at the top of this page. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
